3D Marks:
Typically,
three-dimensional marks include the shape of the products
themselves or their wrapping, package etc. According to a
recently developed practice, the IIPO accepts applications
for three-dimensional marks. In addition to the documents
required for filing ordinary trademarks and service marks,
all dimensions (namely front, top and side) must be clearly
represented.
Collective/Certificate
Marks:
Collective
mark is a trademark used to distinguish products of a group
of farmers, manufacturers, traders etc or of a town, city
and a region of a country. For registration of a collective
mark, applicants must furnish either notarized certificate
issued by a competent authority (such as trade union,
chamber of commerce/industry, municipal etc) attesting their
right to use of the mark, OR a certified copy of home or any
other country’s registration certificate.
Service Marks:
According to
the new legislation, which has been effective since June
2003, applicants may register marks in international service
classes (35 to 45).
Previously all service marks were registered in class 32. As
regards procedure and requirements, filing an application
for service marks is the same as for other trademarks.
Color Marks:
Color marks
may be registered and protected in Iran; According to a
recent practice, IIPO accepts applications for color marks.
Applicants are required to clearly state the colors and mere
description of the color is sufficient as the IIPO
classifies color marks according to the International
Classification of Figurative elements of Marks. It should be
noted that, colors per se are not registerable but single or
multi color trademarks are registerable. Color trademarks
are not printed in colors, but related colors are described
in the trademark application, trademark certificate and the
Official Gazette. Moreover, a sample of the color mark is
available at the IIPO for public reference.
NOTE: Sound marks and smell marks are not registerable under
the present Iranian trademark law.
