There are 4
types of patents:
1- Patent of convention:
Patent of
convention is based on a foreign application (priority) and is
valid for a period of twenty years from the Iranian filing
date. This type of patent must be filed within the twelve
months from the original filing date.
2- Patent of
importation:
Patent of importation is based on a foreign granted patent
and is valid for the remaining term of the foreign patent.
3-
Independent patent:
Patent of independence is a patent that is not based on
any abroad registration or application. The life of the patent
is for twenty years from filing date in Iran. The patent will
go through formal examination by the Iranian Industrial
Property office.
4- Patent of addition:
Patent of addition is based on any improvement to the
existing granted patent in Iran. It is required to file a new
application for this type of patent. In case a patent of
addition is based on patent belonging to someone else, the
patent of addition will not authorize the proprietor to use
the basic patent, nor the original inventor (owner of the
basic patent) to use the patent of addition, unless they reach
an agreement.
