Anyone claiming one of the following, may apply for a patent:

1-     New innovation in a new industrial product.

2-     Discovery of a new means/method or using an existing means/method to achieve a new result or product in industry, agriculture etc.

      3-     Priority based on a foreign application/patent

The first person applying for the registration of an invention, in accordance with the law, shall be considered the inventor of the patent, unless proven otherwise. Furthermore, the owner of a patent based on a foreign patent (patent of importation), cannot apply to the court for an injunction against infringements that had been initiated prior to their application. Therefore, immediate application for a patent is of vital importance. However, due consideration should be paid to non-patentable subject matters, namely:

      1-     Financial schemes.

      2-     Any invention or improvement of an existing invention contrary to public policy, public morals or public health.

 

  Requirements for filing a patent application

 The following documents must be filed together with, and at the same time as, the application:

   -  Name and address of the applicant.

 

 

   -Title of the invention.

 

 

 - Power of attorney duly legalized up to the Iranian Consulate. A single power of attorney is sufficient for all patents applied for in the name of the same applicant.

 

 

   -Certified copy of the foreign application/registration on which the Iranian application is to be based (in case of patent of convention, patent of importation and patent of addition)

 

 

   -Certified copy of the assignment agreement, unless the foreign patent or priority document is in the name of the applicant.

 -Three sets of the specifications, claims and drawings.
